قرر مجلس مفوضي هيئة الأوراق المالية إحالة شركة الإيمان للاستثمارات المالية إلى التصفية الإجبارية نتيجةً للمخالفات الجسيمة التي ارتكبتها الشركة من جانب ولما تعانيه الشركة من عدم القدرة على مواجهة التزاماتها، وعدم توفر سيولة نقدية لتسيير أعمالها التشغيلية، وعجز في رأسمالها العامل حيث تفوق الالتزامات المستحقة على الشركة موجوداتها المتداولة، وعجز آخر في صافي حقوق ملكية الشركة لتفوق بذلك نسبة خسائر الشركة المتراكمة رأسمالها، هذا بالإضافة إلى أن الشركة توقفت عن ممارسة نشاطها، وذلك وفقاً للنتائج التي خرجت بها لجنتا التدقيق المحلية والخارجية التي شكلتهما الهيئة للتحقق من حسابات وأوضاع الشركة.
وتطبيقاً لأحكام نظام صندوق حماية المستثمرين، أعلنت الهيئة في أعقاب ذلك عن استعدادها لاستقبال طلبات التعويض من عملاء الشركة المتعاملين بالأوراق المالية المتضررين وذلك من أجل النظر في هذه الطلبات ودراستها تمهيداً لاعتمادها وتعويض المستحق منها وفقاً للحالات التي نص عليها نظام الصندوق.
وأكد رئيس هيئة الأوراق المالية محمد صالح الحوراني أن صندوق حماية المستثمرين أنشىء في الأساس لتعويض عملاء الوسيط المالي المتعاملين بالأوراق المالية عن خسائرهم التي قد يتعرضون لها إذا ما تم تحويل الوسيط المالي للتصفية الإجبارية، وقد نص النظام كاشتراط ضروري لقبول المطالبات واستحقاق التعويض على ثلاث حالات هي: قيام الوسيط المالي بالتصرف في الأوراق المالية العائدة لهم دون تفويض، أو قيام الوسيط المالي بالتصرف في المبالغ النقدية المستحقة في حساباتهم دون تفويض، أو قيام الوسيط المالي بالتصرف في الأوراق المالية والمبالغ النقدية العائدة لهم دون تفويض.
وأضاف الحوراني أنه تم الإعلان في الصحف المحلية وفي الموقع الإلكتروني للهيئة وعلى صفحات التواصل الاجتماعي الخاصة بها عن إمكانية البدء باستقبال طلبات التعويض لدراستها والنظر فيها واعتماد المستحق منها، حيث يمكن للعملاء المتضررين التقدم بمطالباتهم للصندوق عبر الموقع الإلكتروني للهيئة أو بالحضور الشخصي لمبنى الهيئة، مشيراً إلى أنه يمكن الاطلاع على نظام صندوق حماية المستثمرين وعلى إعلان التقدم للتعويض والنموذج الخاص به عبر زيارة صفحتي التشريعات- الأنظمة، وآخر الإعلانات المتوفرتين على الموقع الإلكتروني للهيئة www.jsc.gov.jo.
